Crewzz AI — Terms of Service

1. Description of Service

Crewzz AI provides an AI-powered platform that generates interior design and real estate space-staging visuals, including furniture placement, material replacement, lighting adjustments, and related image or video transformations ("Outputs"). The Service is intended for use by homeowners, real estate agents, interior designers, photographers, architects, and other professionals.

2. Eligibility and Account Registration

• You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
• To access certain features, you must register for an account and provide accurate, current, and complete information.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to notify us promptly of any unauthorized use of your account.

3. Acceptable Use

When using the Service, you agree that you will not:

• Upload, submit, or process any image, video, or material that you do not have the legal right to use, including copyrighted or trademarked content owned by others.
• Use the Service to generate content that is unlawful, infringing, defamatory, fraudulent, sexually explicit, discriminatory, or misleading.
• Use the Outputs to misrepresent the physical condition, features, or characteristics of a property in a manner intended to deceive buyers, tenants, or other third parties.
• Attempt to reverse-engineer, decompile, or otherwise access the underlying models or source code of the Service.
• Use automated means (bots, scrapers) to access the Service without our prior written consent, or interfere with the Service's normal operation.
• Use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law.

We reserve the right to suspend or terminate accounts that violate this section.

4. User Content

• You retain all ownership rights to the photos, floor plans, and other materials you upload to the Service ("User Content").
• By uploading User Content, you grant Crewzz AI a limited, non-exclusive, royalty-free license to process, store, and use that content solely for the purpose of providing and improving the Service, including generating Outputs at your request.
• You represent and warrant that you have all necessary rights, consents, and permissions to upload and use the User Content you submit, including any required consent from property owners or occupants.

5. AI-Generated Outputs and Intellectual Property

• Subject to your compliance with these Terms and an active, paid subscription (where applicable), you may use Outputs generated through the Service for personal or commercial purposes, including real estate listings and marketing materials.
• Crewzz AI retains all rights, title, and interest in and to the Service itself, including its underlying software, machine learning models, algorithms, designs, and trademarks.
• Due to the nature of generative AI technology, Outputs may not perfectly reflect the actual physical space, dimensions, or condition of a property. Outputs are provided for visualization and marketing purposes only and should not be relied upon as a factual representation of a property's condition.
• Where required, you are responsible for clearly disclosing to buyers, tenants, or other viewers that images have been virtually staged or digitally altered using AI, in accordance with applicable real estate advertising regulations in your jurisdiction.

6. Subscriptions, Fees, and Payment

• Certain features of the Service require a paid subscription. Current plans and pricing are available on our website and may be updated from time to time.
• Subscriptions automatically renew at the end of each billing cycle unless canceled prior to the renewal date.
• All fees are exclusive of applicable taxes unless stated otherwise.
• Refunds: Refund requests submitted within 7 days of initial purchase, and prior to substantial use of the Service, may be eligible for a refund at our discretion. Refund requests made after this 7-day period, or following substantial usage of the Service, will generally not be honored.
• We reserve the right to change our pricing with reasonable advance notice to active subscribers.

7. Third-Party AI Models

The Service may utilize third-party AI models and infrastructure to generate Outputs. We do not guarantee the availability, accuracy, or continuity of any specific third-party model and may substitute or update the underlying technology at our discretion without affecting your rights under these Terms.

8. Disclaimers

• The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.
• Outputs are generated by artificial intelligence and are provided for illustrative and marketing purposes only. They do not constitute professional interior design, architectural, engineering, appraisal, or legal advice.
• We are not responsible for any decisions made, or transactions entered into (including real estate purchases, sales, or leases), based on Outputs generated by the Service.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Crewzz AI and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be limited or excluded under applicable law.

10. Indemnification

You agree to indemnify and hold harmless Crewzz AI and its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.

11. Suspension and Termination

• We may suspend or terminate your account, in whole or in part, if you violate these Terms, engage in fraudulent or abusive activity, or for any other reason at our reasonable discretion, with or without notice.
• You may cancel your account and stop using the Service at any time through your account settings or by contacting support.
• Sections of these Terms that by their nature should survive termination (including Sections 5, 8, 9, 10, and 13) will continue to apply after termination.

12. Changes to the Service and These Terms

• We may modify, suspend, or discontinue any part of the Service at any time.
